RISK OF LOSS

All items purchased from BNMS ENTERPRISES are made pursuant to a shipment contract. A shipment contract basically means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

PRODUCT DESCRIPTIONS

BNMS ENTERPRISES attempts to be as accurate as possible. However, BNMS ENTERPRISES does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current or error-free. If a product offered by BNMS ENTERPRISES itself is not as described, your sole remedy is to return it in unused condition.

NO RESPONSIBILITY TO SELL MISPRICED PRODUCTS OR SERVICES

BNMS ENTERPRISES shall have the right to refuse or cancel any orders placed for products and/or services listed at an incorrect price, rebate or refund, or containing any other incorrect information or typographical errors. BNMS ENTERPRISES shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your payment received. If your payment has been received and your order is canceled, BNMS ENTERPRISES shall immediately issue (a) a credit to your PayPal account or (b) a refund by company check, in the amount of the charge.

MODIFICATIONS TO PRICES OR BILLING TERMS

BNMS ENTERPRISES RESERVES THE RIGHT, AT ANY TIME, TO CHANGE ITS PRICES AND BILLING METHODS FOR PRODUCTS OR SERVICES SOLD, EFFECTIVE IMMEDIATELY UPON POSTING ON THE SITE OR BY E-MAIL DELIVERY TO YOU.

All prices on the site are kept as updated as possible. We reserve the right to inform you of any price changes when we go to process your order, in case there are any errors or out of date prices. DISPUTES

Any dispute relating in any way to your visit to BNMS ENTERPRISES or to products you purchase through BNMS ENTERPRISES shall be submitted to confidential arbitration in the state of Texas, United States of America, except that, to the extent you have in any manner violated or threatened to violate BNMS ENTERPRISES’ intellectual property rights, BNMS ENTERPRISES may seek injunctive or other appropriate relief in any state or federal court in the state of Texas, United States of America, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

SITE POLICIES, MODIFICATION, AND SEVERABILITY

Please review our other policies, such as our Returns policy (below). These policies also govern your visit to BNMS ENTERPRISES. We reserve the right to make changes to our site, policies, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

RETURNS POLICY

By agreeing to these terms and conditions, you agree to abide by our return policy. BNMS ENTERPRISES reserves the right to modify or change the return policy at any given time.

  • Satisfaction is guaranteed for our products. If dissatisfied, you may return it for a full refund (not including shipping).
  • A return authorization (RA) must be requested from BNMS ENTERPRISES BEFORE any item is returned.
  • The email should include the following information:
  • Description of the merchandise you wish to return.
  • Description of why the merchandise is being returned (e.g. “merchandise damaged”, “did not fit”, “not satisfied with the merchandise”, etc.)
  • Customer name, billing address, shipping address, phone number, email address and BNMS Invoice number.
  • Only items that were purchased from directly from BNMS ENTERPRISES and/or this website may be returned for exchange or refund.
  • Customers are responsible for all return shipping costs unless the product received was damaged in shipment.
  • All return requests must be received by BNMS ENTERPRISES within 30 days of the invoice date.
  • All returns MUST be in the original, saleable condition and include any original packaging with any tags still attached.
  • You accept all risks when installing any product from this webpage. BNMS ENTERPRISES shall not be held responsible for any damage to yourself, your vehicle or your property. You must accept all risks prior to using any of our items. We do not refund you for any installation, removal or repair charges incurred on your end.
  • We reserve the right to refuse any return that does not meet our return policy criteria.
  • Any item that is returned may be charged a restocking and repackaging fee based on item type. The amount of this fee (if any) will be disclosed to you when the Return Authorization is approved. This fee is charged for returning and replacing the item in sellable condition. The purchaser is responsible for return shipment of any returned or exchanged item for any reason.

  • Returned items must be shipped in a sealed, insured package, with the RA confirmation number included in the package.
  • You will be notified via email or USPS mail once your return/exchange has been received and a refund or exchange has been processed.
  • Please note that your requested exchange item may be out of stock by the time your return is received.
  • If your exchange is out of stock or on back order, a refund will be issued.

ACKNOWLEDGEMENT

You acknowledge (a) that you have read and understood this Agreement; and (b) that this Agreement has the same force and effect as a signed agreement.
